US investment managers Carlyle Capital have tabled a £28 million bid for Derby, they are apparently investigating the possibility of not paying either preferred Football debt or HMRC and taking a 15 point deduction instead thus getting Derby on the cheap….albeit a League I club (although with the current points deductions Derby are likely headed our way anyway).
Everything will depend on the timing of the points deduction, I suspect Binney would want to ensure the 15 point deduction was in this season not next.
I’m not strong on this part of UK Corporate law but it’s an interesting ploy which, if Binney was able to successfully exploit the opportunity, would encourage a lot of other Potential owners of struggling clubs to do the same thing.
